1. Introduction

These terms of service (the “Terms”) govern use of the Respire mobile app (the “App”), published by:

The Respire App is an iOS and Android app offering guided breathing protocols for breath problems linked to stress or anxiety. It offers targeted protocols, daily audio sessions, wind-down mini-games, a personalized mini-plan and relief tracking.

2. Purpose

These Terms set out the conditions under which Vision Publishing LLC makes the Respire App and related services available to the user, as well as the subscription conditions.

By downloading and using the App, the user accepts these Terms without reservation. If the user does not accept these conditions, they must not use the App.

3. Access to the App

The iOS and Android versions of Respire are distributed through the App Store and Google Play respectively, depending on their availability in the user's country. A compatible device and an internet connection are required to download the App and for certain features. Purchases are tied to the store account used; an Apple subscription is not automatically transferred to Google Play, nor the other way round.

Downloading the App and creating the local profile are free. Access to the practice area requires an active subscription, which may be preceded by a trial if the store confirms the user's eligibility.

4. Subscription

4.1. Any trial or launch offer

A trial or launch offer may be available in the App. The exact conditions are shown in the App and by the relevant store before any purchase is confirmed.

4.2. Subscription details

Subscription details, including any offer and renewal information, are shown in the App before any purchase. The user is invited to review them directly in the App.

4.3. Automatic renewal

On Google Play, renewal takes place on the date indicated by Google. To avoid the next payment, cancel renewal before that date; for a trial, cancel before it ends. The exact conditions and price are shown by Google before confirmation.

4.4. How to cancel

The user can cancel their subscription at any time by following the steps below:

1. Open Settings app on iPhone
2. Tap your name (Apple Account) at the top of the screen
3. Tap Subscriptions
4. Select Respire
5. Tap Cancel subscription

On Android, open Google Play → profile picture → Payments and subscriptions → Subscriptions → Respire → Cancel subscription. You can also use the Google Play subscriptions page. After cancellation, access remains available until the date indicated by the store. Uninstalling the app or erasing its data does not cancel the subscription.

5. Payment

Payment is handled by Apple through the App Store or by Google through Google Play. Vision Publishing LLC has no access to the user's payment information, including card numbers.

Billing information and payment history are available from the store used for the purchase. Our support team can also help identify the right procedure.

6. Right of withdrawal

Under Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior agreement.

By starting to use the App and its services, the user expressly acknowledges waiving their right of withdrawal.

The user may request a refund from the store used, according to its rules and applicable legal rights: Apple or Google Play.

7. Personal data

The processing of the user's personal data is described in our privacy policy, which the user is invited to review.

8. Intellectual property

All elements making up the App (texts, graphics, software, images, sounds, animations, trademarks, logos) are the exclusive property of Vision Publishing LLC or its partners and are protected by intellectual property laws.

Any reproduction, representation, modification, publication or adaptation of all or part of these elements is prohibited without the prior written authorization of Vision Publishing LLC.

9. Limitation of liability

Vision Publishing LLC strives to ensure the App works properly but does not guarantee uninterrupted availability. Vision Publishing LLC cannot be held liable for direct or indirect damage linked to the use of, or inability to use, the App.

10. Changes to these terms

Vision Publishing LLC reserves the right to change these Terms at any time. The user will be informed of any significant change by a notification in the App or by email. Continued use of the App after the Terms are changed constitutes acceptance of the new conditions.

11. Governing law and jurisdiction

These Terms are governed by the law of the State of New Mexico, United States of America. In the event of a dispute, the parties will try to reach an amicable solution. Failing that, the dispute will be submitted to the competent courts of New Mexico.

For users located in the European Union, the mandatory consumer law provisions of their country of residence apply in addition to these conditions.
